At a glance
- Bespique is a marketplace. When you buy, your contract is with the Seller, not with Bespique.
- Bespique collects payment on the Seller's behalf as their commercial agent.
- You must be 18 or over and resident in the United Kingdom to use Bespique as a buyer.
- Bespoke items are made to your measurements. Once the Seller starts work, your order cannot be cancelled (this is a legal exception — see clause 10 and the Refund Policy).
- Ready-to-wear items can be cancelled within 14 days of delivery under UK law.
- Your statutory consumer rights are not affected by anything in these Terms.

1. About these Terms
1.1 These Terms of Service ("Terms") govern your access to and use of bespique.com and any related services (the "Platform") operated by BESPIQUE LIMITED, a company registered in England and Wales under number 16939121 whose registered office is at Platned Ltd, Europa House Gerrards Cross, Marsham Way, Gerrards Cross, United Kingdom, SL9 8BQ ("Bespique", "we", "us", or "our").
1.2 By creating an account, placing an Order, or otherwise using the Platform, you ("you", "your", "User") agree to these Terms. If you do not agree, do not use the Platform.
1.3 These Terms apply to Users acting as Buyers. Users acting as Sellers are separately bound by the Seller Agreement, which these Terms incorporate by reference. Where you act as both Buyer and Seller, both documents apply.
1.4 Specific services or promotions may have additional terms. In the event of conflict, the specific terms prevail for the specific service only.
2. Definitions
In these Terms:
- "Bespoke Product" means a Product made or adjusted to specifications supplied by the Buyer (including measurements or 3D body scans) such that it falls within regulation 28(1)(b) of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
- "Buyer" means a natural person who places an Order via the Platform.
- "Content" means any text, images, reviews, messages, measurements, or other material submitted to the Platform.
- "Listing" means an offer to sell a Product published on the Platform by a Seller.
- "Order" means a contract formed between a Buyer and a Seller via the Platform.
- "Platform" has the meaning given in clause 1.1.
- "Product" means an item of clothing, an accessory, or another item offered for sale by a Seller via the Platform.
- "Ready-to-Wear" or "RTW" means a Product that is not a Bespoke Product.
- "Seller" means a User permitted by Bespique to publish Listings and sell Products via the Platform.
3. Our role — marketplace, not seller
3.1 Bespique operates a marketplace. We provide technology that enables Sellers to list Products and Buyers to purchase them. We are not the seller, manufacturer, importer, or distributor of any Product sold via the Platform.
3.2 When you place an Order, a contract is formed directly between you and the Seller for the sale of the relevant Product. Bespique is not a party to that contract.
3.3 Bespique acts as the Seller's commercial agent for the limited purpose of concluding Orders and collecting payment on the Seller's behalf. Payment to Bespique in this capacity discharges the Buyer's obligation to pay the Seller for the Product.
3.4 Bespique does not endorse, inspect, pre-approve, or guarantee any Listing, Product, or Seller. Seller verification steps described on the Platform do not amount to a warranty by Bespique that any Seller is suitable or any Product is of satisfactory quality.
4. Eligibility and accounts
4.1 You must be at least 18 years old to use the Platform. By using the Platform you represent that you are 18 or over.
4.2 Buyers must be resident in the United Kingdom and accept delivery to a UK address. We do not currently offer the Platform to Buyers outside the UK.
4.3 You must provide accurate and up-to-date information when creating an account and maintain its confidentiality. You are responsible for all activity under your account.
4.4 You agree to notify us immediately at support@bespique.com of any suspected unauthorised access.
4.5 We may refuse, suspend, or terminate accounts in accordance with clause 16.
5. Listings
5.1 Listings are published by Sellers. Bespique does not guarantee the accuracy, completeness, or currency of any Listing.
5.2 Each Listing should state whether the Product is Bespoke or Ready-to-Wear, the price in GBP, estimated delivery time, and materials. For Products dispatched from outside the UK, customs duties and import VAT are handled in accordance with clause 7.3 — Buyers are not required to pay any additional amount on delivery.
5.3 Product images are indicative. Minor variations in colour, texture, grain, and finish are inherent to bespoke and artisanal production and do not, by themselves, make a Product non-conforming.
6. Placing an Order
6.1 An Order is placed when you submit a valid payment through the Platform. No contract is formed until the Seller accepts the Order, which occurs automatically on successful payment capture unless the Seller declines within 24 hours.
6.2 If the Seller declines, we will refund the Buyer in full within 5 Business Days using the original payment method.
6.3 By placing an Order for a Bespoke Product, you confirm that you have read and understood clauses 10 and 11 and the Refund Policy regarding cancellation limitations.
7. Price, payment, and VAT
7.1 All prices are shown in pounds sterling (GBP) and are inclusive of UK VAT (where chargeable) unless otherwise stated on the Listing.
7.2 We use third-party payment providers to process Payments. You authorise Bespique and its payment providers to charge your chosen payment method for the total amount of your Order.
7.3 Overseas Sellers — duties paid by Seller. Where a Product is dispatched from outside the UK:
(a) for consignments with a value not exceeding £135, Bespique collects UK VAT at checkout under the HMRC marketplace rules described in clause 7.4. The Buyer pays nothing additional on delivery;
(b) for consignments with a value exceeding £135, the Seller is required to ship on a Delivered Duty Paid (DDP) basis. UK import VAT and customs duty must be pre-paid by the Seller through the courier (for example via Royal Mail PDDP, DHL, FedEx, or UPS DDP services) and included in the shipping cost shown to the Buyer at checkout. The Buyer must not be required to pay any additional amount on delivery.
If a Buyer is incorrectly charged customs fees on delivery for an overseas consignment, Bespique will refund the Buyer and recover the amount from the Seller in accordance with the Seller Agreement.
7.4 Marketplace VAT. Where required by HMRC (including for consignments of imported goods not exceeding £135 sold by overseas Sellers to UK consumers), Bespique collects and remits UK VAT as a marketplace operator. The Buyer remains liable to pay that VAT as part of the Order price.
7.5 VAT registration. Bespique is in the process of registering for UK VAT. Until registration is confirmed, Bespique does not separately add UK VAT to Bespique's own service charges (e.g. commission). UK VAT on Products is the responsibility of the relevant Seller, and where applicable is collected by Bespique on the Seller's behalf as a marketplace operator under HMRC rules described in clause 7.4. This clause will be updated to publish Bespique's VAT number once registration is confirmed.
8. Delivery
8.1 Estimated delivery windows are set by the Seller on each Listing. Unless the Seller states otherwise, delivery will occur within 30 days of contract formation in accordance with regulation 42 of the Consumer Contracts Regulations 2013.
8.2 If delivery has not been made within the later of (a) the Seller's stated estimate plus 14 days or (b) 30 days from contract formation, the Buyer may cancel the Order and receive a full refund, without prejudice to other statutory rights.
8.3 Risk of loss or damage passes to the Buyer on delivery.
9. Measurement data (Bespoke Orders)
9.1 Buyers of Bespoke Products must provide accurate measurement information, whether by manual entry, standard size selection, or 3D body scan.
9.2 By submitting measurement data you give explicit consent to Bespique processing it as special category data and sharing it with the relevant Seller for the purposes of fulfilling your Order. See the Privacy Policy for full details.
9.3 Match-or-refund remedy. Where a Bespoke Product is delivered:
(a) if the finished garment matches the measurements supplied by the Buyer (within standard manufacturing tolerances of ±1 cm), the Buyer is not entitled to a refund or remedy on the basis of fit;
(b) if the finished garment does not match the measurements supplied (i.e. a Seller manufacturing or measurement error), the Buyer is entitled to a full refund of the Order price plus return shipping at the Seller's cost, in accordance with the Refund & Returns Policy.
Bespique does not offer or arrange alteration services at this time.
10. Cancellation, refunds, and faulty goods
10.1 Your cancellation and refund rights are set out in the Refund & Returns Policy, which forms part of these Terms.
10.2 In summary:
- Ready-to-Wear Products — 14-day right to cancel under the Consumer Contracts Regulations 2013.
- Bespoke Products — no right to cancel once the Seller has marked the Order "In Production", due to the statutory exception for goods made to consumer specification (regulation 28(1)(b)).
- Faulty Products — all statutory rights under the Consumer Rights Act 2015 apply (short-term right to reject within 30 days; right to repair, replacement, or refund thereafter).
10.3 Nothing in these Terms excludes or limits your statutory rights as a consumer. If any clause conflicts with those rights, your statutory rights prevail.
11. Disputes between Buyer and Seller
11.1 If a Buyer has a problem with a Product or a Seller, the Buyer should first contact the Seller using the in-Platform messaging function.
11.2 If the matter is not resolved within 7 days, the Buyer may escalate via support@bespique.com.
11.3 Bespique is not a party to the Buyer-Seller contract but may, at its discretion, intervene to facilitate resolution, hold funds pending outcome, reverse transfers, or refund Buyers where the Seller has breached the Seller Agreement. Such intervention is provided as a goodwill service and does not amount to an acceptance of liability by Bespique for the Seller's conduct or the Product.
12. Reviews and user content
12.1 Buyers may submit reviews of Sellers and Products after an Order is marked Delivered.
12.2 Reviews must be honest, based on genuine experience, and must not be defamatory, unlawful, or otherwise in breach of the Acceptable Use Policy.
12.3 By submitting any Content (including reviews, photos, and messages) you grant Bespique a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, sub-licensable, and transferable licence to use, reproduce, modify, display, and distribute that Content for the purposes of operating, promoting, and improving the Platform.
12.4 We may remove any Content at our discretion where it breaches these Terms or the Acceptable Use Policy.
13. Acceptable use
13.1 Your use of the Platform is subject to the Acceptable Use Policy.
13.2 You may not use the Platform to facilitate any unlawful activity, misrepresent your identity, circumvent fees, scrape data, introduce malware, or impair the Platform's operation.
14. Intellectual property
14.1 The Platform, including its software, design, trade marks, and content (other than Seller Listings and User Content), is owned by Bespique or its licensors. All rights are reserved.
14.2 Seller Listings are owned by Sellers, who grant Bespique the licence described in the Seller Agreement.
14.3 You are granted a limited, non-exclusive, revocable licence to access and use the Platform for its intended purpose only.
15. Notice-and-takedown (intellectual property complaints)
15.1 If you believe any Content on the Platform infringes your intellectual property rights, send a written notice to support@bespique.com including: (a) your contact details; (b) identification of the work allegedly infringed; (c) identification of the allegedly infringing material and its URL; (d) a statement that you believe in good faith the use is unauthorised; and (e) a statement, made on pain of perjury, that the information is accurate and that you are (or are authorised to act on behalf of) the rights holder.
15.2 We operate a notice-and-takedown procedure consistent with the Electronic Commerce (EC Directive) Regulations 2002 and will act expeditiously on valid notices.
16. Suspension and termination
16.1 We may suspend or terminate your access to the Platform, remove Listings, reverse transactions, or refuse further service where we reasonably believe that:
(a) you have breached these Terms, the Seller Agreement, or the Acceptable Use Policy; (b) you have engaged in fraud, misrepresentation, or abusive conduct; (c) your continued use presents a legal, regulatory, reputational, or security risk to us, other Users, or third parties; or (d) we are required to do so by law or regulation.
16.2 Where possible and lawful, we will give you notice and an opportunity to remedy. In urgent or serious cases, suspension may be immediate.
16.3 You may close your account at any time via your account settings or by emailing support@bespique.com. Pending Orders must be completed before closure.
16.4 Clauses that by their nature should survive termination (including 3.3, 7, 10, 12, 14, 17, 18, 19, 20, 22) will survive.
17. Liability
17.1 Non-excludable liability. Nothing in these Terms excludes or limits liability for:
(a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; (c) breach of the Consumer Rights Act 2015 or other statutory consumer rights that cannot be excluded by law; or (d) any other liability that cannot be lawfully excluded or limited.
17.2 Exclusion of indirect loss. Subject to clause 17.1, Bespique is not liable for any:
(a) loss of profits, revenue, business opportunity, goodwill, or anticipated savings; (b) loss of data; (c) indirect or consequential loss; or (d) loss arising from the acts or omissions of Sellers or other third parties.
17.3 Cap on liability. Subject to clause 17.1, Bespique's total aggregate liability to any Buyer under or in connection with these Terms is limited to the greater of:
(a) £100; or (b) the total fees (including commission) paid by the Buyer to Bespique or the Seller via the Platform in the 12 months immediately preceding the event giving rise to the liability.
17.4 No liability for Sellers. Bespique is not liable for any act, omission, breach, or default of any Seller, or for the quality, safety, legality, or fitness for purpose of any Product. Your remedies in respect of the Product lie against the Seller.
18. Indemnity
18.1 You agree to indemnify and hold harmless Bespique, its affiliates, and their officers, employees, and agents against any losses, damages, claims, liabilities, costs, and expenses (including reasonable legal fees) arising from:
(a) your breach of these Terms, the Acceptable Use Policy, or any applicable law; (b) your Content; (c) your misuse of the Platform or another User's Content; or (d) any claim by a third party arising from (a), (b), or (c).
18.2 This clause does not limit your statutory rights as a consumer.
19. Data protection and privacy
19.1 We process personal data as described in the Privacy Policy.
19.2 Where we share personal data with Sellers for the purpose of fulfilling Orders, the Seller is an independent controller of that data from receipt and must comply with UK GDPR and the Data Protection Act 2018.
20. Variation
20.1 We may amend these Terms from time to time. Material amendments will take effect 30 days after notice is given to registered Users by email or prominent Platform notice. Non-material amendments (including typographical corrections and updates to reflect minor operational changes) take effect on posting.
20.2 Continued use of the Platform after an amendment takes effect is acceptance of the amended Terms. If you do not accept, you may close your account under clause 16.3.
21. General
21.1 Force majeure. Neither party is liable for failure or delay in performance caused by events beyond its reasonable control (including natural disasters, industrial action, failure of utilities or telecommunications networks, cyber-attack, pandemic, and governmental action). Statutory consumer rights are unaffected.
21.2 Severability. If any provision of these Terms is held unenforceable, the remainder continues in force.
21.3 No waiver. Failure to enforce a provision is not a waiver of the right to do so later.
21.4 Entire agreement. These Terms, together with documents they incorporate (Privacy Policy, Refund Policy, Acceptable Use Policy, and, for Sellers, the Seller Agreement), are the entire agreement between you and us in respect of their subject matter. Statutory consumer rights are unaffected.
21.5 Assignment. We may assign or transfer our rights and obligations under these Terms (for example, as part of a corporate reorganisation or sale). You may not assign yours without our prior written consent.
21.6 Third parties. A person who is not a party to these Terms has no rights under the Contracts (Rights of Third Parties) Act 1999 to enforce them, except that our affiliates may enforce clauses 17 and 18.
21.7 Notices. Notices to us must be sent to support@bespique.com. Notices to you may be given to the email address registered on your account and are deemed received 24 hours after sending.
22. Governing law and jurisdiction
22.1 These Terms and any dispute arising out of or in connection with them (including non-contractual disputes) are governed by the law of England and Wales.
22.2 The courts of England and Wales have non-exclusive jurisdiction to settle any dispute. As a UK consumer, you retain the right to bring proceedings in the courts of the part of the UK in which you are resident.
22.3 We are not currently members of an alternative dispute resolution (ADR) scheme. You may, however, pursue a complaint through the small claims track of the County Court in England and Wales, or equivalent in other parts of the UK.
