Acceptable Use Policy

At a glance

Bespique is a marketplace for clothing and accessories. To keep it safe, fair, and legal for everyone, we have a few clear rules:

  • Don't list or buy anything prohibited (see the list below — fur, exotic leathers, weapons, counterfeit goods, etc.).
  • Don't try to defraud, manipulate, or harass other users.
  • Don't try to break, scrape, or misuse the Platform itself.
  • Treat other users with respect.

Breaking these rules can lead to your Listing being removed, your account being suspended or terminated, your funds being held, or in serious cases, your details being reported to the police or other authorities.


1. Scope

1.1 This Acceptable Use Policy ("AUP") applies to all Users of bespique.com (the "Platform") operated by BESPIQUE LIMITED.

1.2 The AUP forms part of the Terms of Service and the Seller Agreement. Capitalised terms have the meanings given there.

1.3 Bespique can update this AUP at any time. Material changes are notified by email or prominent Platform notice.


2. Prohibited Products

You may not list, sell, advertise, or attempt to sell any of the following via the Platform:

2.1 Animal-derived materials

  • Real fur of any kind, including pelts, trim, lining, or pom-poms (whether farmed or wild). Faux fur clearly described as such is allowed.
  • Exotic leathers and skins, including (without limitation) crocodile, alligator, snake, python, lizard, ostrich, stingray, eel, and any other reptile, amphibian, or fish skin.
  • Materials from CITES-listed species (Convention on International Trade in Endangered Species), regardless of permit status.
  • Ivory of any kind (banned under the Ivory Act 2018).
  • Tortoiseshell, whalebone, or other materials from protected marine species.
  • Wild bird feathers (other than from species farmed lawfully for food, such as chicken, duck, goose, ostrich).
  • Angora wool (rabbit fur).
  • Karakul / Astrakhan / Persian lamb pelts.
  • Down or feathers that are not certified to a recognised animal-welfare standard (e.g. Responsible Down Standard).

Bespique's policy is stricter than UK law. Materials lawful in the UK but listed above are still prohibited on the Platform.

2.2 Counterfeit, infringing, and replica goods

  • Counterfeit goods, replicas, or any items that bear a third party's trade mark or logo without authorisation.
  • "Inspired by" or "in the style of" Listings that closely imitate trade-marked or design-protected products.
  • Items that infringe third-party copyright, design rights, or other intellectual property.

2.3 Adult and sexual products

  • Adult or sexual products of any kind, including (without limitation) lingerie marketed as fetish or sexual wear, sex toys, BDSM gear, and adult costumes intended primarily for sexual use.

Standard lingerie, swimwear, and sleepwear are allowed; the prohibition is specifically on items marketed for sexual or fetish use.

2.4 Weapons and dangerous goods

  • Knives, swords, blades, or any item classified as an offensive weapon under the Offensive Weapons Act 2019.
  • Replica or imitation firearms.
  • Body armour intended for civilian use without lawful authorisation.
  • Tear gas, pepper spray, or any irritant intended for self-defence.
  • Items containing or shipped with hazardous substances (e.g. flammable accelerants, lithium batteries above carrier limits, mercury).

2.5 Regulated, restricted, and controlled items

  • Tobacco, e-cigarettes, vapes, and related products.
  • Alcohol.
  • Controlled drugs and any drug paraphernalia.
  • Prescription medicines, medical devices, contact lenses.
  • Live animals or animal carcasses.
  • Food and food supplements.
  • Cosmetics not compliant with UK / EU cosmetics safety regulations.
  • Children's products that do not comply with UK product safety regulations (BS EN 14682 cords/drawstrings, BS 5722 nightwear flammability, etc.).
  • Items requiring an import or export licence (other than where the Seller holds the licence and discloses it).
  • Asbestos, radioactive materials, or any controlled substance.

2.6 Stolen, recalled, or unlawful goods

  • Stolen goods or goods you don't have legal title to sell.
  • Goods subject to a manufacturer or regulatory recall.
  • Sanctioned items, or items destined for sanctioned persons / countries (UK, EU, US, UN sanctions lists).

2.7 Hateful, discriminatory, or offensive content

  • Items, designs, or imagery that promote terrorism, violence, hatred, or discrimination on grounds of race, religion, sex, sexual orientation, gender identity, disability, or any other protected characteristic.
  • Holocaust denial, Nazi symbols (other than for clearly historical / educational purposes), or symbols of proscribed terrorist organisations under the Terrorism Act 2000.
  • Items glorifying violence against any person or group.

2.8 Other categories

  • Cryptocurrency or NFT-only Listings.
  • Gambling-related products.
  • Lottery tickets, raffle tickets, or any product whose value is contingent on chance.
  • Anything else prohibited by UK law applicable to the sale.

Bespique may, at its discretion, classify other items as prohibited. We will give Sellers notice and a reasonable time to remove or amend Listings.


3. Prohibited conduct

You must not, and must not attempt to:

3.1 Fraud and abuse

  • Misrepresent your identity, age, location, business status, or qualifications.
  • Use another person's account without permission.
  • Create multiple accounts to evade enforcement, manipulate reviews, abuse promotions, or circumvent fees.
  • Issue or accept payment for goods or services that will not be delivered, or that materially differ from what was advertised.
  • Submit, solicit, or incentivise fake reviews (positive or negative).
  • Abuse the refund / dispute system (e.g. claiming non-delivery for items that were delivered, returning a different item, or returning a worn item as unworn).
  • Engage in chargeback abuse or "friendly fraud".

3.2 Off-Platform circumvention (Sellers)

  • Solicit or accept payment off-Platform for transactions first arranged on the Platform.
  • Direct Buyers to external sites, payment methods, or contact details to avoid Bespique's fees, agency role, or dispute processes.
  • Include website URLs, email addresses, social media handles, or telephone numbers in Listings, Product photos, or initial Buyer messages, except where Bespique has expressly permitted (e.g. brand profiles).

3.3 Harassment and abuse of other Users

  • Harass, threaten, intimidate, defame, dox, or stalk any User.
  • Send unsolicited commercial communications via Platform messaging.
  • Discriminate against any User on grounds of any protected characteristic under the Equality Act 2010.
  • Share another User's personal data outside the Platform without lawful basis.

3.4 Abuse of Bespique support and dispute processes

  • Abuse, threaten, or use racist, sexist, homophobic, transphobic, or otherwise discriminatory language towards Bespique staff, contractors, or service providers.
  • Submit knowingly false or misleading information in disputes, refund requests, or appeals.

3.5 Misuse of the Platform itself

  • Scrape, crawl, harvest, or systematically download Listings, Product images, reviews, or User data, except via APIs we expressly authorise.
  • Reverse-engineer, decompile, or attempt to extract the source code of the Platform.
  • Bypass, disable, or interfere with security, rate-limiting, anti-bot, or authentication features (including CAPTCHA).
  • Introduce malware, viruses, or other malicious code.
  • Conduct denial-of-service, brute-force, credential-stuffing, or other attacks.
  • Probe, scan, or test the vulnerability of the Platform without express permission via our security disclosure programme (when published).
  • Use the Platform to send spam, phishing messages, or malicious content.
  • Frame the Platform within another site, mirror it, or use automation to interact with it (other than search engine crawlers respecting robots.txt).

3.6 Tax, financial, and regulatory misconduct

  • Provide false information for the purposes of tax (UK or overseas), customs, or anti-money-laundering checks.
  • Use the Platform for money laundering, terrorist financing, or any other financial crime.
  • Sell to or facilitate sales to sanctioned persons, entities, or countries.

3.7 Misuse of measurement and personal data (Sellers)

  • Use a Buyer's measurements, 3D body scan, or other personal data for any purpose other than fulfilling the relevant Order.
  • Retain, share, sell, or further process such data in breach of the Seller Agreement clause 12.

4. Reporting violations

4.1 If you believe a Listing, message, review, or User behaviour breaches this AUP:

(a) use the in-Platform "Report" button on the relevant item; or (b) email support@bespique.com with details and (where possible) a link or screenshot.

4.2 We aim to acknowledge reports within 2 Business Days and act on serious violations as a priority.

4.3 If you believe content infringes your intellectual property rights, follow the notice-and-takedown procedure in clause 15 of the Terms of Service.

4.4 We do not publicly identify reporters except where required by law or court order.


5. Enforcement

5.1 If we reasonably believe a User has breached this AUP, we may take any of the following actions, without notice where the breach is serious:

  • remove or amend Listings, Content, or messages;
  • restrict account features (e.g. publishing new Listings, sending messages);
  • hold Order funds or refunds pending investigation;
  • reverse transfers or claw back commission;
  • suspend the account temporarily;
  • terminate the account permanently;
  • prevent re-registration of associated accounts;
  • recover sums owed to Bespique or other Users;
  • report the matter to the police, HMRC, the ICO, Trading Standards, brand-protection bodies, or other authorities; and / or
  • take legal action.

5.2 The action we take is proportionate to the breach. For first-time minor breaches we will normally give notice and a chance to remedy.

5.3 We may, at our discretion, allow appeal of an enforcement decision via support@bespique.com. Bespique's decision is final on Platform-administrative matters; this does not affect your right to take the matter to court.


6. Cooperation with authorities

6.1 We will cooperate with valid requests from law enforcement, regulators, courts, or rights-holders, including disclosure of User information where lawfully required (UK Data Protection Act 2018 schedule 2 paragraph 2, Investigatory Powers Act 2016, court order, or equivalent).

6.2 We may proactively report suspected criminal activity to the police, the National Crime Agency, HMRC, the ICO, or other authorities.


7. Online Safety Act notice (illegal content and content harmful to children)

7.1 As a UK-facing user-to-user service that allows messaging and reviews, Bespique falls within the scope of the Online Safety Act 2023. We commit to:

  • swift removal of illegal content (terror, child sexual abuse material, fraud, threats, hate, etc.) on becoming aware of it;
  • providing easy reporting mechanisms for illegal and harmful content (clause 4);
  • transparent enforcement action under clause 5;
  • proportionate measures to protect users under 18, including the requirement that all Users be at least 18 (clause 4.1 of the Terms of Service).

8. Changes to this AUP

We may update this AUP. Material changes are notified by email or prominent Platform notice at least 30 days before they take effect, except where a change is required by law or to address an immediate safety / security risk (which takes effect on posting).
